Terms and conditions

The vehicle is the property of Topo Moto S.L. Topo Moto S.L. reserves the right to rent or not rent the vehicle for company-related reasons.

1. USE OF THE VEHICLE
The renter receives the vehicle and accessories described on the front in perfect working condition and agrees to maintain it properly, complying with traffic rules.
It is strictly forbidden to:
a) Transport people or goods when this implies, directly or indirectly, subleasing the vehicle.
b) Drive the vehicle while physically impaired due to alcohol, drugs, fatigue, or illness.
c) Use the vehicle to push or tow other vehicles.
d) Participate with the vehicle in any sporting event.
e) Tamper with or remove the odometer seal. Any malfunction must be reported immediately to Topo Moto S.L.
f) Drive on sand (beaches) or unpaved roads.
g) Allow unauthorized persons (not listed on the front of the contract) to drive the vehicle.
h) Take the vehicle off the island.

2. VEHICLE RETURN
The vehicle must be returned at the date, time, and location specified in the contract. Any change must be previously authorized by Topo Moto S.L.
Failure to comply allows Topo Moto S.L. to take legal action to recover the vehicle.

3. RENTAL CHARGES
The renter agrees to pay, in addition to rental fees and taxes according to current rates, any costs for lost documents, tools, and accessories (except keys), valued at €31, as well as any fines and legal expenses arising from traffic violations or breaches of laws or regulations by the renter.
The initially agreed rate is valid only if the vehicle is returned at the specified place and date.
A delay of up to three hours will be charged at €6 per hour; beyond three hours, the full deposit will be charged.
3a. The renter agrees to return the vehicle with the same fuel level.
Otherwise, the missing fuel will be charged, plus a refueling fee.
Additionally, charges will apply in case of:
Loss or damage of the key.
Returning the vehicle with less fuel than when it was received.

4. REPAIRS
Topo Moto S.L. will cover minor expenses during the rental such as oil changes or small repairs (except flat tires) up to a maximum of €4, which must be justified with receipts. Prior authorization is required from Topo Moto
S.L. for repairs exceeding €4 or for towing services.

5. INSURANCE
The insurance contracted by Topo Moto S.L. covers the renter and authorized drivers against third-party liability, up to a limited amount, and includes legal bail and defense if criminal proceedings are involved.
Not considered third parties for insurance purposes: the renter’s or driver’s spouse, parents, children, or siblings. Loss, theft, or damage to items inside the vehicle, as well as glass and windows, are not covered.
The renter is fully covered in case of theft (excluding parts), fire caused by mechanical failure, or accident. However, in case of negligence, a deductible of €300 must be paid, plus the days the vehicle is in the workshop.

6. ACCIDENTS
In case of an accident, the renter agrees to:
a) Not admit or assume responsibility.
b) Immediately notify authorities if the other party is at fault. If no authority is involved, the insurance will not cover the incident.
c) Obtain all details from the other party and complete the accident form with vehicle documents, sending it urgently to Topo Moto S.L., including a phone call in case of serious accidents.
d) If the conditions in section 1 are violated, the insurance becomes void and the renter must cover all damage and downtime.

7. LIABILITY OF TOPO MOTO S.L.
Topo Moto S.L. states it has taken all necessary precautions to prevent vehicle failures, but if such occur, the company is not responsible for any direct or indirect harm caused to the renter.

8. JURISDICTION
Any dispute between Topo Moto S.L. and the renter will fall under the jurisdiction of the courts of Ibiza, with the renter expressly waiving any other jurisdiction.
The handling of personal data is governed by Organic Law 15/1999 on Personal Data Protection (LOPD).
Regardless of nationality, the renter declares having read these terms and conditions.

NOTES:
Taking the vehicle off the island is prohibited.
The deductible depends on the type of insurance contracted.
Any damage caused by the renter will always be their responsibility.
